Blog Post: Have less than 50 EEs? Don't mention FMLA or CFRA!

If you have less than 50 employees... you are not REQUIRED to offer leave under FMLA or CFRA.  But, did you know that mentioning either of these in your employee handbook can be viewed by the courts that you, the employer, "Opted In."  When you "Opt In" you are required be compliant with the rules and regulations.  If you do not wish to offer FMLA or CFRA and are not Required to... leave these out of our employee handbook.  The San Diego Employers Association regularly reviews employee handbooks for its members.  We recommend that you have your employee handbook reviewed for compliance once every couple years at a minimum.
